1. About PEAK and these terms

This website and online store is operated by PEAK, a trading name of Noah Industries Pty Ltd (ABN 86 649 230 553) ("PEAK", "we", "us", "our"). PEAK previously traded online as Peak 4x4, and the Peak 4x4, Peak Werks and Peak Expedition ranges are all sold under these terms. By browsing the site, requesting a consultation or quote, or placing an order, you agree to these Terms of Service together with our Shipping Policy, Refund Policy, Privacy Policy and Cancellations policy, which form part of these terms. If you do not agree, do not use the site or place an order.

We may update these terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Our store is hosted on Shopify, which provides the platform we use to sell our products.

2. Who can order

You must be at least 18 years old, or have the authority of someone who is, to place an order. You agree to give us accurate, current and complete contact, delivery and billing details and to keep any account credentials confidential. You are responsible for activity under your account.

3. Products, specifications and fitment

We sell aftermarket parts and accessories for a range of vehicles, many of which are manufactured for us in batches or made to order. Product images are for illustration; finish, hardware and minor details can differ between production runs. Specifications, weights, dimensions, load ratings and compatibility notes are provided in good faith from our own data and our suppliers' data and can change without notice.

Fitment information is a guide to help you choose the right product. Vehicle variants, factory options, previous modifications and body styles can affect fit. It is your responsibility to confirm that a product suits your vehicle before you buy, and we encourage you to ask us if you are unsure. Where you supply vehicle details and we confirm fitment in writing, we rely on the accuracy of the details you gave us.

4. Consultations and advice

PEAK does not operate a showroom. We offer free 30 minute consultations by video call or phone at a time we confirm with you by email. Advice we give during a consultation or in correspondence is general product guidance based on the information you provide. It is not a substitute for an inspection of your vehicle by a qualified installer or engineer, and final decisions on suitability, legality and installation rest with you and your installer.

5. Prices and payment

All prices are in Australian dollars and include GST where it applies. Shipping is calculated and shown at checkout before you pay. Prices, promotions and availability can change at any time without notice, and a change does not affect an order we have already accepted.

We accept major credit and debit cards, PayPal, Afterpay and Zip. Buy now pay later products are provided by those companies under their own terms, eligibility criteria and fees; PEAK is not the credit provider. For larger purchases you can ask for finance through a licensed finance broker, as set out in section 6. Payment must be received in full before an order is dispatched or released for collection, unless a deposit or staged payment arrangement has been agreed in writing.

If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the affected order and refund any payment, even after an order confirmation has been sent, and we will contact you to offer the correct price before doing so where practical.

6. Finance

Who arranges your finance. PEAK is not a lender or a finance broker, does not provide credit and does not give advice about credit. If you ask for finance through our website, we refer you to Loan Options AI Pty Ltd (ABN 75 641 873 716), Australian Credit Licence 543631 ("LoanOptions"), a licensed finance broker. LoanOptions deals with you directly. It gives you its credit guide and privacy statement, works out what you need, compares lenders and arranges any loan with the lender you choose. Every loan is subject to the lender's credit assessment, approval, terms and fees.

What we pass on. With your consent, given on the enquiry form, we send LoanOptions your name, email address and mobile number, the amount you want to finance, your preferred loan term, whether the loan is for personal or business use, and the product or page you enquired from. We do not ask about your income, expenses, employment or credit history. LoanOptions then contacts you, usually by phone.

Rates and repayments. PEAK does not quote interest rates, comparison rates, fees or repayments. Any figures you are given come from LoanOptions or a lender, and only they can tell you what a loan will cost.

Our commission. If a loan we referred settles, LoanOptions pays PEAK a referral commission of 20% of LoanOptions' net commission on that loan, worked out after LoanOptions' direct costs and after LoanOptions has kept a minimum of $695. You do not pay PEAK anything for the referral, and the commission is not added to your purchase price. Making an enquiry does not oblige you to take a loan.

Your order is separate. Your purchase from PEAK and any loan are separate contracts. A finance enquiry or approval does not reserve stock or hold a price, and unless we agree otherwise in writing, an order is not conditional on finance approval. Payment for your order is due under these terms and our Cancellations policy whether or not finance is approved. If you need finance before you commit, talk to us before you order or pay a deposit.

Buy now pay later. Afterpay, Zip and PayPal's pay later options are offered at checkout by those providers, under their own terms and eligibility checks. Instalment amounts shown on our site are a guide to the provider's standard plan; the provider confirms your actual schedule and any fees.

Complaints about finance. If you have a complaint about your loan, the broking service or a lender, contact LoanOptions or the lender first. If it is not resolved, you can contact the Australian Financial Complaints Authority at afca.org.au or on 1800 931 678. If your complaint is about how PEAK handled your referral, contact us at support@peakbuilt.com.au.

7. Orders and acceptance

Your order is an offer to buy. We accept it when we dispatch the goods, notify you that they are ready for collection, or otherwise confirm acceptance in writing; an automatic order confirmation email is a record of your order, not acceptance. We may decline or cancel an order, in whole or in part, where stock is unavailable, where we suspect fraud, reselling or misuse, where the delivery address cannot be serviced, or where an error has occurred, and we will refund any payment taken for the cancelled portion.

8. Pre-orders, deposits and purchase options

Some products are offered for pre-order, by deposit, by staged payment or against incoming stock. The expected timing shown at the time of purchase is an estimate. Our Cancellations policy sets out how these orders can be changed or cancelled, and payments made under these options are not refundable for change of mind.

9. Shipping and collection

Delivery options, timeframes, bulky freight requirements and warehouse collection are set out in our Shipping Policy. Risk in the goods passes to you on delivery to the address you nominated, or when the carrier records a delivery under an authority to leave, or when you collect the goods. Title passes when we receive payment in full.

10. Returns, refunds and warranty

Our Refund Policy covers change of mind returns, transit damage, incorrect items and warranty claims. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

11. Installation, compliance and use

Our products must be installed by a suitably qualified and licensed installer, following the supplied instructions and the vehicle manufacturer's requirements, and used only for their intended purpose and within their stated ratings. Vehicle modifications are regulated, and requirements for matters such as lift height, wheel and tyre sizes, bull bars, load ratings and certification differ between states and territories. You are responsible for ensuring that the products you buy, and the way they are installed and used, comply with the laws, Australian Design Rules and registration requirements that apply to your vehicle, and for any effect on your vehicle's warranty or insurance. Off-road and recovery equipment must be used in accordance with its ratings and instructions; misuse can cause serious injury.

12. Intellectual property

The PEAK, Peak 4x4, Peak Werks and Peak Expedition names and logos, and all content on this site including product designs, photographs, videos, drawings, installation guides, descriptions and software, are owned by or licensed to Noah Industries Pty Ltd and protected by intellectual property laws. You may view and print pages for your personal use in dealing with us. You may not copy, reproduce, distribute, modify, scrape or commercially exploit any part of the site or its content, or use our names or logos, without our written permission.

13. Website content, errors and availability

We take care to keep the site accurate and current, but we do not promise that the content is complete, correct or error free, and we may correct errors, update information or withdraw products at any time without notice. We do not guarantee that the site will be available at all times or free of faults, and we may suspend or restrict access for maintenance or security reasons.

14. Third party services and links

Payment, finance, freight, review and other services provided by third parties are governed by those providers' own terms. Links to third party websites are provided for convenience; we are not responsible for their content, products or practices, and your dealings with them are between you and them.

15. Reviews, photos and submissions

If you send us feedback, reviews, photos, videos or suggestions, or tag us on social media, you give us a perpetual, royalty free licence to use, reproduce, edit and publish that material to promote PEAK and its products, and you confirm that you have the right to grant it and that the material is not unlawful, misleading or infringing. We may remove reviews that are fake, abusive or unrelated to a genuine purchase.

16. Acceptable use

You must not use the site for any unlawful purpose, attempt to gain unauthorised access to our systems or data, interfere with the site's security or operation, scrape or harvest data, upload malicious code, place fraudulent orders or impersonate another person. We may suspend or terminate access and cancel orders where we suspect a breach of these terms, and we may refer unlawful conduct to the authorities.

17. Chargebacks and disputes

If something has gone wrong with your order, contact us first at support@peakbuilt.com.au and give us a reasonable opportunity to resolve it. We respond to emails within one business day. A chargeback or payment dispute raised without first contacting us, or that disputes a transaction you authorised, is a breach of these terms, and we may recover the costs of defending it to the extent the law allows.

18. Liability

To the extent permitted by law, PEAK is not liable for indirect or consequential loss, including loss of profit, loss of use, vehicle downtime, installation and removal costs, travel costs or third party charges, arising out of the supply or use of our products or the site. Where liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so. Nothing in this section limits your rights under the Australian Consumer Law.

You indemnify PEAK, Noah Industries Pty Ltd and our directors, employees and contractors against claims, losses and costs arising from your breach of these terms, your misuse of our products, or your breach of any law or third party right.

19. Privacy

We handle personal information in accordance with our Privacy Policy.

20. General

These terms, together with the policies they refer to and the details of your order, are the entire agreement between you and PEAK for your purchase. If any part of these terms is found to be unenforceable, the rest remains in force. A failure by us to enforce a term is not a waiver of it. These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts entitled to hear appeals from them.
