Privacy policy
Last updated: 20 October 2026
PEAK is a trading name of Noah Industries Pty Ltd (ABN 86 649 230 553) ("PEAK", "we", "us", "our"). We operate peakbuilt.com.au and the PEAK online store, including Peak 4x4, Peak Werks and Peak Expedition products, together with the related tools, content and services (the "Services"). This Privacy Policy explains how we collect, hold, use and disclose personal information, and how you can access it, correct it or make a complaint. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
By using the Services or providing us with your information, you agree to the handling described in this policy. If this policy conflicts with our Terms of Service on a privacy matter, this policy applies.
The information we collect
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Depending on how you deal with us, we may collect:
- Identity and contact details: your name, email address, phone number, and billing and delivery addresses.
- Order and payment details: the products you buy, your order history, payment method and the transaction confirmations we receive from our payment providers. We do not store full card numbers; payments are processed by our payment providers on their secure systems.
- Vehicle details you give us so we can confirm fitment, such as make, model, year and variant, and any photos or measurements you send.
- Account details if you create a customer account, including login credentials and saved preferences.
- Communications: emails, phone calls, consultation bookings, web forms, chat messages, reviews and anything else you send us.
- Finance enquiry details if you ask for finance through our website: your name, email address and mobile number, the amount you want to finance, your preferred loan term, whether the loan is for personal or business use, and the product or page you enquired from. We do not collect credit information, credit reports or details of your income, expenses or employment.
- Technical and usage data collected automatically when you browse: IP address, device and browser type, pages viewed, products viewed and added to cart, referral source and similar analytics, gathered through cookies, pixels and similar technologies.
We do not treat de-identified or aggregated data as personal information.
How we collect it
We collect information directly from you when you place an order, create an account, request a consultation or quote, send a finance enquiry, subscribe to our emails, leave a review, enter a promotion or contact us. We collect technical and usage data automatically through our website platform and analytics and advertising tools, including the Shopify platform, Google and Meta tags and pixels. We also receive information from service providers acting for us, for example delivery confirmations from our freight partners and payment confirmations from our payment providers, and from public sources where permitted by law.
Why we collect and use it
We use personal information to:
- process and fulfil your orders, arrange delivery or collection, and send order and tracking updates;
- confirm fitment, answer enquiries, run consultations and provide customer support;
- pass your finance enquiry to our finance broker when you ask us to and consent to it;
- handle returns, warranty claims and transit damage claims;
- take payment, screen for fraud and manage chargebacks and disputes;
- send you marketing about PEAK products, launches and offers where you have opted in or where the law otherwise allows, and show you relevant advertising on our site and on third party platforms;
- invite you to review products you have purchased;
- understand how the Services are used so we can improve them, our range and our content;
- meet our legal obligations, enforce our policies and protect our rights, our customers and the public.
Who we share it with
We share personal information only where needed to run the business and provide the Services, with:
- Shopify, which hosts our store and processes orders, payments and customer data on our behalf;
- payment providers, including Shopify Payments, PayPal, Afterpay and Zip, to process your payment;
- Loan Options AI Pty Ltd (Australian Credit Licence 543631), a licensed finance broker, when you send a finance enquiry and consent to us passing it on. We send LoanOptions your name, contact details and loan details, the product or page you enquired from, a reference that matches the enquiry to your cart, and how you reached our site (such as campaign tags and Google or Meta advertising click identifiers). LoanOptions handles your information under its own privacy policy and credit guide, which it gives you, and may share it with lenders to arrange finance. PEAK receives a referral commission from LoanOptions if a loan settles, as explained in our Terms of Service;
- Cloudflare, which runs the secure server that passes finance enquiries from our website to LoanOptions. That server keeps a short technical log of each enquiry (a reference number, loan type, amount and term) but does not store your name or contact details;
- our warehousing and freight partners and their carriers, together with the tracking notification service they use, so your order can be delivered and you can follow it;
- email, SMS and marketing platforms that send our communications, and the review platform that collects and displays product reviews;
- advertising and analytics platforms such as Google and Meta, which may use cookie and pixel data to measure our advertising and show you relevant ads;
- product manufacturers and suppliers where needed to resolve a warranty or technical claim;
- our professional advisers, including accountants, insurers and lawyers;
- government agencies, regulators, courts and law enforcement where required or authorised by law;
- a purchaser or prospective purchaser of our business or its assets, under confidentiality obligations.
We do not sell your personal information.
Overseas disclosure
Some of our service providers store or process data outside Australia. Shopify processes data in Canada, the United States and other locations where it operates, and other platforms we use, including Google, Meta and our email and review platforms, may store data in the United States or elsewhere. Cloudflare processes finance enquiries on its global network, which may route them through servers outside Australia. Where we disclose personal information overseas we take reasonable steps to ensure the recipient handles it in a way consistent with the Australian Privacy Principles, including relying on the provider's own privacy commitments and contractual protections.
Cookies and tracking
Our website uses cookies and similar technologies to keep your cart and session working, remember your preferences, measure how the site is used and support advertising. You can control cookies through your browser settings, although some parts of the Services may not work properly without them. To opt out of personalised advertising, use the ad settings offered by Google and Meta in your accounts with those platforms.
Marketing choices
You can unsubscribe from our marketing emails at any time using the link in any message, or by emailing info@peakbuilt.com.au. Reply STOP to opt out of marketing SMS. Opting out of marketing does not stop service messages about your orders, deliveries, claims or account.
Security and retention
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure, including access controls, encryption in transit and reliance on the security of our major platform providers. No system is completely secure, and you should keep your account credentials confidential. We keep personal information for as long as it is needed for the purposes described above, to meet our record keeping obligations (including tax and consumer law records, generally seven years) and to resolve disputes. When it is no longer needed we delete or de-identify it.
Access, correction and complaints
You can ask for access to the personal information we hold about you, or ask us to correct it, by emailing info@peakbuilt.com.au. We will verify your identity before releasing information and will respond within a reasonable time, normally within 30 days. If we refuse a request we will tell you why.
If you believe we have breached the Australian Privacy Principles, please raise it with us first and we will investigate and respond in writing. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
If you are located in the United Kingdom or the European Economic Area, you may have additional rights under local data protection law, including the right to withdraw consent and to lodge a complaint with your local supervisory authority. For data processed by Shopify, Shopify's own privacy policy and privacy portal also apply.
Children
The Services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided information to us, contact us and we will delete it.
Third party websites
Our site links to third party websites and platforms, including payment, finance, social media and review services. Their privacy practices are their own, and you should read their policies before providing personal information.
Changes to this policy
We update this policy when our practices or the law change. The current version is always available on this page with its "Last updated" date.
